Historic district rentals

The older housing around the downtown square is largely individually owned, often divided into units, and sometimes with the owner living on site. Owner occupancy matters: the Fair Housing Act exempts owner-occupied buildings of four units or fewer, so establish whether your landlord lives in the building before you assume the Act applies.

Historic properties also come with genuine practical constraints — original floors, no fenced yard, shared entrances. None of those defeat an accommodation, but they shape what a landlord will worry about, and addressing the worry directly tends to work better than ignoring it.

New subdivisions and associations

West and north McKinney are new construction inside property owners associations governed by the Texas Residential Property Owners Protection Act. As in neighbouring Frisco, the association is a second party whose rules can reach you through your lease. It cannot use pet restrictions to defeat a lawful accommodation, but it can generate a violation notice to your landlord that arrives before anyone speaks to you.

Ask who notifies the association, and get the answer in writing.

Growth and turnover

McKinney has been among the fastest-growing cities in the country, and management companies here turn over staff quickly. The person who approved your accommodation last year may be gone. Keep your approval, the therapist's letter and the correspondence together somewhere you can find them at renewal.

Where to complain in Collin County

If a McKinney housing provider denies a request you believe was lawful, there are three routes and they are not mutually exclusive.

  • The Civil Rights Division of the Texas Workforce Commission enforces the Texas Fair Housing Act statewide.
  • HUD's Office of Fair Housing and Equal Opportunity handles complaints under the federal Act. Deadlines apply, so do not sit on it.

My landlord lives in the other half of the duplex. Am I covered?

Possibly not. Owner-occupied buildings with four units or fewer are exempt from the Fair Housing Act. You can still ask, but you are making a request rather than asserting a right.

Do I have to re-request at every renewal?

Not usually, but many Texas landlords ask for documentation dated within the last twelve months. Keeping your original approval and correspondence makes renewal far simpler.

The same limits apply everywhere in Texas

An ESA letter is housing documentation. It does not create public access rights in McKinney shops, restaurants or hotels, and it has not helped with air travel since the Department of Transportation rule took effect in early 2021.
