Fort Bliss and privatized housing

Fort Bliss is one of the largest installations in the Army, and its family housing is privatized — owned and run by a private operator under a long-term agreement. Privatized military housing is generally subject to the Fair Housing Act, so a reasonable accommodation request is available to you, but the operator will have its own form, its own review chain, and sometimes a notification step involving your command.

Ask the housing office for the written procedure before submitting anything. Soldiers tell us they were handed a pet registration form and assumed that was the process; it is not, and filing an animal as a pet can undercut the accommodation you are entitled to.

Language and documentation

A large share of El Paso households speak Spanish at home. A therapist's letter written in English is still valid documentation regardless of the language you speak, and a landlord cannot require you to produce it in a particular language. If you need the request itself written in Spanish, say so — and if a leasing office insists on English-only communication for something they handle bilingually for other tenants, that is worth raising.

Cross-border complications

El Paso has a genuinely binational population, and some residents split time across the border. Your therapist can only evaluate you while you are physically located in Texas. That is a licensing rule and there is no way around it: if you are in Ciudad Juárez during the appointment, the evaluation is not valid.

Where to complain in El Paso County

If a El Paso housing provider denies a request you believe was lawful, there are three routes and they are not mutually exclusive.

  • The Civil Rights Division of the Texas Workforce Commission enforces the Texas Fair Housing Act statewide.
  • HUD's Office of Fair Housing and Equal Opportunity handles complaints under the federal Act. Deadlines apply, so do not sit on it.

Can I do the evaluation from Juárez?

No. Your therapist's license authorises practice with people physically located in Texas. What matters is where you are sitting during the appointment, not where you live or where the therapist is.

Does my Fort Bliss housing operator have to accept the letter?

It has to consider the request. Privatized military housing is generally treated as private housing under the Fair Housing Act, so the usual analysis applies, including the limits on what documentation may be demanded.

An ESA letter is housing documentation. It does not create public access rights in El Paso shops, restaurants or hotels, and it has not helped with air travel since the Department of Transportation rule took effect in early 2021.
